In Eviction Lawsuits Due to Need, the Mandatory Mediation Application as a Condition for Filing a Lawsuit Must Be Made After the Right to File the Eviction Lawsuit Has Arisen
Pursuant to the relevant article of the Turkish Code of Obligations, eviction lawsuits due to need may be filed at the end of the term in fixed-term lease agreements, and in indefinite-term lease agreements, as of the date determined in accordance with the general provisions on leases by complying with the termination period and the notice requirements. Therefore, in the mandatory mediation application, which is a precondition for filing a lawsuit, the application must be made after the right to file the eviction lawsuit has arisen. In other words, if the mediation application is made before the period for filing the lawsuit begins, the requirement of mandatory mediation as a precondition for the lawsuit will not have been fulfilled.
